Heavy Equipment and Machinery Liens are Complex

Unlike vehicles, these assets are not typically titled - which easily provides the legal owner and lienholder information. Rather, they are secured through by Uniform Commercial Code (UCC) through each Secretary of State (SOS). Although there may be progress for simplified searches in the future, currently Heavy Equipment liens are NOT searchable by VIN or Serial number. 

Further complications include due diligence, as the buyer's burden and the lien follows the machine. In simple terms it means the buyer must document asking, validating, searching and clearing the seller/asset for liens. Should they transact without proper due diligence, the asset can legally be seized by the existing lienholder without recourse. The buyer would then need to pursue recourse with the seller through the traditional court system.
